María Fernanda Espinosa refers to Karin Law investigation protocol

The national media El Mercurio published an article about the three key points of the regulation published by the Ministry of Labor on the Karin Law. The document describes the guidelines to which all investigations of sexual harassment, labor harassment and workplace violence within companies and by the Labor Directorate (DT) must conform, including the form of sanction.

In this regard, our partner María Fernanda Espinosa, said that the investigation can be conducted internally in the company or referred to the DT. With the beginning of the investigations, ‘they must immediately adopt the necessary measures of protection to safeguard those involved, some of the measures that can be adopted are the separation of physical spaces, teleworking or early psychological care through the mutual to which the company is affiliated’.

In addition, the Ministry of Labor pointed out that the regulation establishes that ‘the procedures for the investigation of sexual harassment, labor harassment and violence at work must be strictly subject to the following principles: gender perspective, non-discrimination, no re-victimization or secondary victimization, impartiality, celerity, reasonableness, due process and collaboration’.

The Karin Law enters into force on August 1.
