Our senior associate, Isidora Fernández, of the Dispute Resolution team referred to the adjustments in out-of-court collections established in the draft reform of the National Consumer Service (Sernac), which seeks to modify the maximum ceilings of out-of-court collections.

In her article in the national newspaper “El Mercurio”, Isidora highlighted that the bill eliminates the possibility of automatic collection of debt, “declaring as abusive those clauses that establish the anticipated evaluation of the amounts to be collected, either judicially or extrajudicially”.
