Law No. 21,210 incorporated amendments to both Article 28 of the Tax Code and Article 13 of the Income Tax Law (LIR), obliging the manager of a partnership or joint venture accounts and of any fiduciary assignment (for example, a mandate in its own name), to report the initial and final balances of the participation or account and the respective credits in the form and within the term determined by the Internal Revenue Service (SII) by means of a resolution.
On February 14, 2022, the SII issued Exempt Resolution No. 15, establishing new codes in Form 22, so that the manager complies with the aforementioned obligation.
In the following report, the Tax team of Barros & Errázuriz, makes an analysis of the resolution, its implementation and recommendations.
